Terms of Service
The rules that keep ZOOGABOOG! fair on both sides.
Effective date: May 14, 2026
Plain-English version: use the platform for legitimate business, respect everyone's intellectual property, pay for what you order, and we'll do our best to deliver. There are real legal terms below — please read them.
These Terms of Service ("Terms") govern your use of ZOOGABOOG! — the platform, website, and services we offer. By creating an account or placing an order, you agree to these Terms. They work alongside our Privacy Policy and Cookie Policy.
1. What ZOOGABOOG! is
ZOOGABOOG! is a single platform where small business owners can order branded marketing materials and services — print, signage, apparel, promo, web, and design — all under one account, with their brand applied consistently.
To deliver those products and services, we may use trusted fulfillment partners (printers, shippers, hosting providers, contract designers). From your side it's still one platform, one account, one point of contact — us.
About LiveDesign: LiveDesign is real-time, screen-shared design sessions with a human professional designer. It is not an AI design tool. Pricing and trial terms are described on the LiveDesign page and may be updated from time to time.
2. Accounts and eligibility
- Age: you must be at least 18 to use ZOOGABOOG!.
- Accuracy: give us truthful and current information at sign-up and update it when it changes.
- Account security: you are responsible for keeping your password private and for any activity that happens under your account.
- One account per business: please don't create multiple accounts to game promotions, pricing, or features.
- Authorized use: if you sign up on behalf of a business, you represent that you have authority to bind that business to these Terms.
We may suspend or terminate accounts that violate these Terms, engage in fraud, or abuse the platform — see Section 12 (Termination).
3. Pricing, payment, and refunds
Platform access
Creating an account is free. Browsing the catalog is free. There are no subscriptions and no platform fees. You only pay when you place an order.
How pricing works
- The total price shown at checkout is what you pay — it covers production, our platform services, payment processing, and standard support.
- Shipping and applicable taxes are calculated at checkout based on your address.
- If pricing or specs change after an order is placed, we'll contact you before charging more. Existing orders are honored at the price you agreed to.
Payment
- Payment is captured at the time you place an order.
- Accepted methods: major credit/debit cards (Visa, Mastercard, American Express, Discover) and PayPal, processed by Stripe and PayPal respectively.
- If a payment is declined or charged back, we may pause the order until it's resolved and may restrict accounts with repeated failed payments.
- Invoices and receipts are available in your account dashboard.
Refunds, cancellations, and quality issues
- Before production starts: you can cancel for a full refund.
- After production starts: we may not be able to cancel, or may charge for work already completed and materials already consumed.
- If we made a mistake: if a product is damaged in transit, defective, or doesn't match what you approved, contact us within 7 days of delivery and we'll make it right with a reprint, replacement, or refund.
- Refund timing: approved refunds are processed within 5–10 business days back to the original payment method.

4. Your content and ours
Your content stays yours
You own the logos, designs, images, copy, and any other content you upload to ZOOGABOOG!. By uploading it, you give us a limited, non-exclusive license to use it only as needed to:
- Display it in your account so you can use it.
- Apply it to the products you order.
- Share it with the fulfillment partners required to produce your order.
- Store it so you can reorder later.
We will not use your designs in our marketing or share them publicly without your permission.
Your responsibilities
- You represent that you own or have the right to use everything you upload.
- Don't upload copyrighted images, trademarked logos, or otherwise protected content you don't have rights to.
- If a third party claims your content infringes their rights, you're responsible. We may pause or remove infringing content while the claim is resolved.
Our platform
The ZOOGABOOG! name, logo, character (Doc), the LiveDesign service mark, the platform code, the visual design, and the underlying technology are owned by ZOOGABOOG! or our licensors. You may not copy, scrape, reverse-engineer, or redistribute them without our written permission.
5. Fulfillment, timelines, and quality
Order timelines posted on the site are estimates based on current production and shipping conditions. They are not guarantees. We'll keep you posted on order status, and if there's a delay we'll tell you what we know.
Quality is on us — if your order arrives damaged, defective, or doesn't match what you approved, we'll make it right per Section 3 (Refunds and quality issues).
6. Acceptable use
Don't use ZOOGABOOG! to:
- Break the law or violate anyone else's rights.
- Upload illegal, hateful, obscene, defamatory, or harmful content.
- Infringe on someone else's intellectual property.
- Harass, threaten, or abuse our team or other users.
- Scrape, crawl, or reverse-engineer the platform.
- Create fake accounts, manipulate reviews, or game promotions.
- Introduce malware or attempt to disrupt the service.
- Resell or rebrand ZOOGABOOG! services as your own without a written agreement.
- Impersonate ZOOGABOOG!, our staff, or otherwise misrepresent affiliation.
Violating any of the above may result in immediate account suspension, order cancellation without refund for the violating order, and (where warranted) legal action.
7. Changes to the platform
We're constantly improving ZOOGABOOG!. We may add, modify, or remove features at any time. We'll communicate significant changes in advance when we reasonably can — but we're not liable for losses arising from platform changes, scheduled maintenance, or feature removals.
Pricing and offers may change going forward, but already-placed orders are honored at the price you agreed to.
8. Disclaimers and limitation of liability
To the maximum extent permitted by law:
- The platform is provided "as is" and "as available," without warranties of any kind (express or implied).
- We don't guarantee that the platform will be uninterrupted, error-free, or fully secure.
- Our total aggregate liability for any claim related to ZOOGABOOG! is limited to the amount you paid us for the specific order at issue.
- We are not liable for indirect, incidental, consequential, special, or punitive damages — including lost profits, lost business, or lost data — even if we were advised of the possibility.
Plain-English version: we'll fix what we can fix. If something goes wrong with an order, our financial responsibility is capped at what you paid for that order. We can't take responsibility for consequential business losses on top of that.
9. Things outside our control (force majeure)
We're not liable for delays or failures caused by events outside our reasonable control, including natural disasters, public health emergencies, acts of government, labor disputes, supply-chain disruptions, cyberattacks, infrastructure outages, and similar events. We'll do our best to minimize disruption and keep you informed; performance timelines may extend by the length of the event.
10. Indemnification
You agree to defend and hold ZOOGABOOG!, its owners, employees, and partners harmless from any third-party claims, damages, or reasonable legal fees arising out of:
- Your violation of these Terms.
- Content you uploaded that infringes someone else's intellectual property or other rights.
- Your misuse of the platform.
11. Disputes and arbitration
Informal first. If you have a complaint, please email legal@zoogaboog.com first. We'll try to resolve it in good faith within 30 days.
Binding arbitration. If we can't resolve a dispute informally, both sides agree to settle it through binding arbitration under the rules of the American Arbitration Association (AAA), in California, before a single arbitrator. The arbitrator's decision is final and binding.
Class action waiver. Disputes are resolved individually — not as part of a class, collective, or representative action.
Small claims court. Either side may still bring qualifying claims in small claims court located in California. Each side pays its own arbitration costs unless the arbitrator awards otherwise; for consumer disputes under $75,000, ZOOGABOOG! will cover AAA filing fees.
12. Termination
You can close your account anytime from your settings. Outstanding orders will still be fulfilled and paid for.
We may suspend or terminate accounts that violate these Terms, engage in fraud, or harm other users. For serious violations we may act immediately; for everything else we'll give notice when feasible.
13. Electronic communications
By using ZOOGABOOG!, you agree to receive service-related communications electronically — order updates, security alerts, billing notices, and notices of changes to these Terms or the Privacy Policy. These may come by email, in-app notification, or dashboard alert.
Marketing email is opt-in and you can unsubscribe anytime. Even if you opt out of marketing, you'll still receive transactional and account-related messages.
14. Changes to these Terms
We may update these Terms when our practices, features, or applicable law change. For material changes we'll update the Effective date at the top and notify active account holders by email or in-app notice. Continued use of the platform after a material change means you accept the updated Terms.
15. Other legal bits
- Governing law: these Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles.
- Entire agreement: these Terms together with the Privacy Policy, Cookie Policy, and any order-specific terms make up the entire agreement between you and ZOOGABOOG!.
- Severability: if any provision is found unenforceable, the rest remains in effect.
- No waiver: not enforcing a right doesn't waive it for the future.
- Assignment: you may not transfer your account or these Terms; we may assign them to a successor (for example, in a merger or acquisition).
- Headings: section headings are for convenience and don't affect interpretation.
- Survival: sections on intellectual property, indemnification, liability limits, and dispute resolution survive termination of these Terms.
